Luis Miguel Jiménez
Partner of Von Wobeser y Sierra, he is an International Trade, Customs and, Bankruptcy expert with a very solid knowledge of Arbitration and Taxation with more than 16 years of experience working with a broad range of multinational Fortune 500 clients that are establishing, expanding and operating in Mexico and Latin America. He is an expert in cross-border issues and also has a very solid background in tax related matters and has assisted a large range of clients in solving the complexities of establishing and or operating businesses in Mexico. Furthermore, he has helped companies in successfully complying with the national and international provisions when importing and exporting goods under the different customs regimes available. He also provides strategic consulting and overall business planning counseling, as well as solid litigation advice.
His vast knowledge of the local market and the Mexican judicial system allow him to keep clients protected and aware of any current or substantive and regulatory developments that may be taking place as well as taking preventive measures to avoid risks or problems in the future.
International Trade & Customs
He advises and directs clients in how to interpret and apply international treaties and foreign trade mechanisms. Additionally, he assists clients to obtain benefits derived from administrative programs intended to promote the manufacture of goods and their export abroad and also provides advice in all legal aspects related to the different customs regime and their particular treatment.
He has extensive experience advising clients with Free Trade Agreements and Export Promotion Programs including IMMEX and PROSEC. He also has a very vast experience in the automotive industry advising companies in all segments of the manufacture chain (OEM and auto parts companies). He also has successfully dealt with many issues related to Certification of Origin under different Free Trade Agreements, Customs Classification, Antidumping, Tariff negotiations and Certificates of Origin, Maquiladoras, Audits, reconstruction of Annex 24, compliance of non-tariff regulations and restrictions.
Furthermore, he has negotiated the reduction or elimination of duties on the import of goods as well as certain matters including the generation of Value Added Tax involving the sale within Mexican territory of imported merchandise.
Bankruptcy & Restructuring
In matters of bankruptcy and insolvency he has assisted companies in their character of both distressed entity or creditor. Furthermore, he has successfully advised a foreign entity in a very unique case consisting in acquiring a bankruptcy entity as an ongoing business (only two cases have existed). Additionally he has played a key role in a number of recent high-profile bankruptcy procedures.
